ACTRA Performers’ Rights Society (d/b/a ACTRA RACS) takes the privacy of our members seriously. This Privacy Policy is meant to help you understand what information we collect, why we collect it, and how it is handled.
This Privacy Policy applies to information collected online through the ACTRA RACS website, which includes racs.actra.ca and links from that site to our membership system, ACTRA websites and related microsites. However, you choose to provide information to us, we use security safeguards to help protect your personal information. We are also committed to informing our members about our privacy policies and information handling practices.
Our site may contain links to other websites over which we have no control. ACTRA is not responsible for the privacy policies or practices of other websites you may choose to link to from the ACTRA website.
Any changes to this Privacy Policy will be posted on www.racs.actra.ca. Your continued use of the website will constitute consent to the new privacy policies.
What Information is Collected?
To become a member of ACTRA RACS, it is necessary to complete and submit to us the standard registration form. The registration form contains personal information. Your personal information is protected, and its availability is limited to people who have a “need to know” within the organization as part of their employment duties. The personal information that we collect and maintain includes but may not be limited to:
- ACTRA RACS ID Number
- Performer IPN
- Mandate Information
- Date of Birth and Social Insurance (Social Security) Number
- First and Last Name (Stage and Legal)
- E-Mail Address
- Street Address City/Town Postal Code
- Contact Telephone Numbers
- Agency/Representative Contact Information
- Performer Type
- Residency
- Citizenship
- Gender
- GST/HST/QST Numbers
- Accounting Transactions
How Do We Use the Information We Collect?
The information ACTRA RACS members provide is used to deliver services to our members, including the administration and the distribution of royalties and levies collected on your behalf.
Who We Share Your Information With?
We share your information with third parties, including:
- other ACTRA entities, for the purpose of managing your Account, and calculating, and sending and receiving payments;
- Re:Sound, SCAPR and/or similar organizations that represent you and administer your rights as part of their collective licensing services;
- the Canadian Revenue Agency and other similar foreign government entities for payment reporting for tax purposes; and
- any manager and agent that you have identified in your Account who has fully executed an Appointment of Authorized Representative form or a Power of Attorney.
Where we are required to disclose your information to third parties including agents or other collectives to administer your rights, those third parties are obligated to use your personal information in accordance with the terms of this privacy statement. Additionally, ACTRA RACS may be required to disclose your personal information to the extent required by law, in connection with any legal proceedings, and to establish, exercise or defend its legal rights.
ACTRA RACS does not sell, distribute, or make available your personal information available other than as described herein.
We may use transfer your information to parties located outside Canada. By using the services, you understand that your information may be transferred outside the jurisdiction in which you live and, if your information is processed in a foreign country, it may be subject to foreign laws and accessible to law enforcement and national security authorities within that jurisdiction.
Processing payments
It may be necessary to provide your personal information to applicable financial institutions for the sole purpose of distributing payments to you (e.g. via direct deposit or wire transfer). By signing up for direct deposit, you acknowledge and agree that your personal information will be shared with the financial institution. Your personal information will be used by such entity for its internal use related to fulfilling the transaction services for ACTRA RACS, will be treated in accordance with the institutions privacy policies.
Accessing and Updating Your Information
You may review, correct, or update your personal information at any time. You may also ask ACTRA RACS to edit your information. You may have to provide this request in writing.
We will store your information only as long as is necessary for the purposes for which the information was collected. Thereafter, we will keep your information for a reasonable time in accordance with our standard procedures to comply with our legal obligations, to resolve disputes, prevent fraud and abuse and to enforce our agreements, or as necessary for archival/audit purposes. Even if we delete some or all of your personal information, we may continue to create, retain, or use aggregate or anonymous data.
Security
We use commercially reasonable efforts and security to protect your information on our systems from accidental loss, unauthorized access, use, alteration, or disclosure. However, it is important to recognize that no computer system or online database is completely free from risks of unauthorized intrusions or hacking.
Cookies
During user interaction with one of our internet sites, we may use a browser feature called a ‘cookie’ to collect information anonymously and track user patterns on our websites. A cookie is a small text file containing a unique identification number that identifies your browser – but not you – to our computers each time you visit one of our sites that uses cookies.
